Alianza Americas applauds the action of a federal court in Boston, Massachusetts, which issued an emergency preliminary injunction to prevent the Trump administration from revoking employment authorization (EAD) for thousands of Temporary Protected Status (TPS) beneficiaries from El Salvador, Sudan, and Ukraine who have applied for an extension of their work permits but have not yet received it.

The judicial decision prevents U.S. Citizenship and Immigration Services (USCIS) from carrying out the cancellation of these work permits as of July 22, 2026, as it had announced. While the litigation continues, beneficiaries covered by the court order retain their employment authorization, and employers must respect that protection and refrain from terminating them for that reason.

USCIS had planned to terminate the validity of the work permits, even though TPS for El Salvador remains in effect through September 9, 2026, and for Sudan and Ukraine, TPS remains in effect through October 19, 2026.

Instead of addressing the USCIS delays that have left more than 100,000 Salvadorans waiting for over 14 months for the renewal of their TPS and work permits, the Trump administration took deliberate steps to make life more difficult for TPS beneficiaries. Among other things, it eliminated the automatic 540-day extension for work permits and limited their validity to one year, leaving more than 200,000 people from El Salvador, Sudan, and Ukraine at risk of losing their work authorization.

These actions run counter to the purpose of TPS and seek to create instability for people who fully comply with the law and have authorization to work and protection from deportation. The result has been the loss of jobs, driver’s licenses, housing, and economic stability for thousands of families—not because they broke the law, but because of arbitrary decisions by the administration itself.

Alianza Americas notes that this decision is temporary and will remain in effect while the litigation continues. The preliminary injunction does not extend the validity of work permits beyond September 9, 2026, in El Salvador or beyond October 19, 2026, in Sudan and Ukraine. For employment authorizations to remain valid after those dates, the government must announce an extension of the respective TPS designations.
