ICE must act within the limits of the Constitution: the May 2025 memo confirms its unlawful actions, which must be stopped immediately.
Chicago, IL- Alianza Americas, a national network of 55+ Latin American and Caribbean Immigrant-led organizations, condemns the illegal and unconstitutional ICE memo of May 12, 2025, disclosed by whistleblowers, in which it directs ICE Agents to enter homes and residences to conduct arrests and removals with an administrative deportation order, without a judicial warrant. This memo is another piece of evidence of the unconstitutional and illegal actions of this administration against immigrants, which must be stopped immediately.
As migrant-led and migrant serving organizations have continuously denounced, ICE Agents are acting unlawfully. This memo confirms that these are not the actions of rogue agents but are the consequences of training and orders given by ICE superiors. This is an intentional strategy to act in violation of the U.S. Constitution and U.S. Law to advance the government’s anti-immigrant agenda. The ICE memo must be revoked.
The Fourth Amendment of the Constitution protects the inviolability of the home, protects individuals against unreasonable searches and seizures, and mandates that arrest warrants be issued by a judge specifying the place to be searched and the objects or person to be seized. It ensures a person's safety from unlawful actions by authorities.
As we have stated before, ICE agents are terrorizing our communities, violating human rights, and making them less safe, not more. These abuses are carried out with billions of taxpayer dollars approved by Congress, in an attempt to make lawful practices contrary to our Constitution. This violence is intentional and must cease now.
Enough is enough. We demand immediate action to revoke this ICE memo and to dismiss DHS and ICE officials responsible for drafting, approving, and implementing it. Not one more person, family, or community should suffer at the hands of federal agents acting in violation of the Constitution. We call on Congress to conduct its oversight responsibilities, to fully investigate illegal and unconstitutional ICE activity, and to stop funding abusive enforcement practices.
