Chicago, IL - In a deeply concerning 6–3 ruling, the U.S. Supreme Court has limited the power of federal judges to issue nationwide injunctions, without addressing the constitutionality of Trump’s executive order aimed at ending birthright citizenship.
This shift from nationwide to case-by-case injunctions will fracture legal protections across the country, as states may issue conflicting decisions. Most alarmingly, it significantly weakens a crucial judicial tool that has been used as a check on the executive branch in recent years and to halt potentially harmful federal policies, regardless of whether they come from Democratic or Republican administrations.
In the context of birthright citizenship, the absence of nationwide injunctions threatens to disenfranchise generations of U.S.-born children of immigrants, leaving them vulnerable to statelessness or deportation from their own country. In states that do not challenge harmful policies in court, families risk losing legal recourse altogether. The decision effectively shifts the burden of resisting unconstitutional or damaging policies to individual states and local advocates, rather than ensuring uniform protections nationwide.
“This decision extends far beyond one case. It threatens the ability to combat racist, xenophobic, and harmful policies by this and future administrations. Its impact will be felt by all people living in the U.S., not just immigrants,” stated Dulce Guzmán, Executive Director of Alianza Americas. “Our nation is a democracy, not a monarchy. We are governed by laws that all leaders must uphold. Checks and balances are vital to ensuring that no one, no matter their position, can act above the law” concluded Guzmán.
While administration's goal for this case was not the actual decision on the constitutionality of birthright citizenship, efforts to dismantle birthright citizenship reflect a desire to assert a white, Anglo-Saxon, and European national identity, ignoring the multiethnic and multiracial reality of the U.S.
