District Judge Says, Racism and Xenophobia are not Public Policy. TPS holders from Honduras, Nepal, and Nicaragua are part of our communities

On July 31, 2025, a U.S. District Judge issued a judicial order halting the Department of Homeland Security’s termination of Temporary Protected Status (TPS) for nationals of Honduras, Nepal, and Nicaragua. The decision has immediate effect, preserving TPS for roughly 60,000 long‑standing U.S. residents until at least November 18, 2025, while litigation proceeds.

Judge Thompson found that the Trump administration’s terminations lacked the requisite objective review of country conditions and were potentially motivated by racial animus, citing statements by both Secretary of Homeland Security Kristi Noem and President Trump that characterized immigrants as threats or invaders. In her ruling, she asserted that TPS holders were being effectively told “to atone for their race, leave because of their names, and purify their blood” and memorably declared, “Color is neither a poison nor a crime”.

Collectively, the affected TPS beneficiaries include approximately 7,200 Nepalis, 51,000 Hondurans, and 2,900 Nicaraguans, who have lived in the U.S. for a minimum of 10 to 26 years, working, paying taxes, raising families, and contributing to local economies. The Trump administration's decision to cancel these designations put at risk tens of thousands of people who, for more than 25 years, have put down roots in the United States, who are an integral part of our neighborhoods and communities, and have contributed significantly to their communities, local economies, and the collective well-being of this country.

The administration has repeatedly invoked national security and foreign affairs as a pretext to justify the cancellation of TPS protections. The Judge’s ruling firmly rejected these arguments, making clear that “simply existing in the United States with TPS is not a crime.” In reality, the administration’s actions reflect a broader effort to weaponize immigration policy in order to erode the diversity that defines and strengthens this nation. TPS holders are not national security threats, they are essential members of our communities, contributors to our local economies, and part of the social fabric that makes the United States stronger.

Alianza Americas applauds this decision, the work of the TPS Alliance and ACLU, and demands safety and justice for TPS holders from Nepal, Honduras, and Nicaragua. 

We urge the affected TPS holders to proactively and consistently shape emergency plans with family and close networks, while the litigation continues its path in the courts.
