Chicago, IL — On June 23, the U.S. Supreme Court ruled on an application for a stay on a preliminary injunction. With a 6-3 majority, it decided to stay the injunction pending the appeal's decision, without providing any reasons. Justices Sotomayor, Kagan, and Jackson dissented, stating that in situations as serious as this one, it was preferable to err on the side of caution. The gravity of the Supreme Court’s decision cannot be overstated; it grants this administration the power to forcibly remove immigrants to countries where there is no oversight or accountability for their treatment, placing their lives directly at risk.
Alianza Americas deplores the ruling of the Supreme Court, which fails to protect individuals who face unprecedented dangers under an Administration that views deportations as a tool for inhumane treatment and punishment. A deportation is the administrative decision under which a non-citizen is removed from a country and, in most cases, is returned to their country of origin. Exceptionally, a person may express fear of being returned to a country. Asylum and the Convention Against Torture are designed to protect individuals from threats to their life, personal integrity, and personal freedom. Furthermore, U.S. immigration law provides the Withholding of Removal as an additional protection to ensure that no person is sent to a country where they face danger.
Alianza Americas reiterates that deportation is not a criminal punishment, but a legal process used when a person does not meet the conditions for remaining in a country. As such, they should be subjected to an administrative procedure that ensures due process rights. Deportations are not and should not be lifetime punishments of forced disappearance or indefinite detention in a third country, where they have never been or where they have no family or community ties.
The Supreme Court decisions give the Trump Administration another weapon to dispose of human beings who do not fit his desires for a white supremacist country. Individuals should not, under any circumstances, be arbitrarily sent to any country willing to accept them. The United States government should not be seeking to deport individuals to a third country where their life, safety, and personal freedom are threatened. It is an inhumane action, and it defeats the purpose of a deportation. People deserve a chance to fight their deportation and make their case. Furthermore, immigrants are more likely to stay where they have family, community, opportunities to make a living, and integrate into the country.
In the face of serious and complex human rights violations, the Supreme Court of the United States should have stood on the side of the potential victims.
